- Decongestant class action sputters back to life in Second Circuit
A class action against manufacturers of decongestant medications containing phenylephrine was partially revived by the Second Circuit after the FDA mandated their labels state effectiveness, despite plaintiffs' claims they are no better than a placebo. The court upheld most dismissals but allowed claims about false 'maximum strength' advertising and unclear FDA approval processes to proceed.
