- Sixth Circuit won’t compel RFK Jr. to enforce nondiscrimination provision of ACA
The Sixth Circuit declined to force the federal government to enforce the Affordable Care Act's nondiscrimination provision against private insurers paying nurse anesthetists less than doctors for the same services. The American Association of Nurse Anesthesiology sued the U.S. Department of Health and Human Services, arguing insurers' disparate compensation violates the ACA, but the court found the association lacked standing because the harm stemmed from insurers, not HHS.
